Trinidad, Colo., March 6.-In a verbal decision rendered at the opening of the district court this morning, Judge A. W. McHendrie denied the writ of habeas corpus for “Mother” Mary Jones, the noted woman strike leader held under military guard at the San Rafael Hospital, and remanded the prisoner to the custody of the respondent in the action, Gen. John Chase, commander of the state militia in the strike zone.

The ruling of the court was brief. Immediately upon hearing the decision, attorney F. W. Clark, local counsel for the United Mine Workers, asked for and was granted 60 days to prepare a bill of exceptions to be submitted to the supreme court.

Like [Albert] Hill Case, Says Court.

The court held the case in all essential respects to be the same as the case instituted early in February for others who were held prisoners by the military authorities for alleged connection with the burning of the Southwestern mine tipple and postoffice.

The court in its ruling upheld the powers of the military authorities in arresting and detaining the petitioner under specific instructions form governor Ammons, who in his order to Gen. Chase, declared the woman to be a “dangerous person” and one likely to raise riot or disorder.

To Appeal Case.

But few people were in court when the opinion was rendered this morning. The attorneys for the petitioner will now submit the case on appeal to the supreme court, which a short time ago denied an original application.

WILLIAM BENTON AND MOTHER JONES

William Benton was deprived of his life in Mexico by armed men. Mother Jones is deprived of her liberty in Colorado by armed men.

There is war in Mexico and Benton was accused of various acts forbidden under martial law. There is no war in Colorado, only a miners’ strike. Mother Jones is not accused of any acts forbidden by civil or martial law.

Benton was tried and declared guilty on evidence offered before a court martial, at the age of about 50. Mother Jones has had no trial before any court. She is an old white-haired woman of 82.

Benton was a native of Great Britain. He had resided in Mexico for many years, amassed a big fortune there, but had not become a citizen. Mother Jones is a native of America. She has lived here all her life. She has not amassed any fortune.

Benton was lord over many thousands of acres of Mexican land, over large herds of Mexican cattle, over thousands of serfs whom they call peons in Mexico. Mother Jones has not lorded it over anybody. She has given her sympathies and her services to her brothers and sisters bent under the heavy load of labor.

Benton was obviously hand and glove with the conspirators that robbed the Mexican people systematically for many years under Porfirio Diaz. He was charged with having given aid to Huerta, the murderous successor of Diaz. His temper was described as impulsive, the treatment of his peons as brutal. Mother Jones is hated and feared by the exploiters of labor because of her unselfish devotion to the workers. She has given aid and comfort to the oppressed in all parts of the country. She is gentle and loving. Her courage is sublime.

Benton’s death stirs two continents. Mother Jones’ unlawful imprisonment creates no stir. Benton was rich. Mother Jones is poor. And we wonder if this is not the reason why so much sympathy goes out to Benton, and so little of it to Mother Jones.
