Miss Luella Twining, who attended the Sixteenth annual convention of the Western Federation of Miners at Denver, reports to the Appeal that no discouragement is observable because of severe trials through which the organization has passed during the Colorado war. Addresses were made by Moyer, Haywood, Lewis and Mother Jones that breathed the militant and aggressive spirit. The late meeting brought about much better feeling between the Western Federation and the United Mine Workers, and it is evident the two organizations will hereafter co-operate. News of the acquittal of Steve Adams was received with demonstrations of joy. Reports from Douglas Island, Alaska, show a bitter fight in progress there. Stockades are built around the mines, and citizens cannot appear on the public highways without being molested by the militia, sent to break the strike. A system of peonage prevails there.

Remembering the Haywood Trial: Witnesses for the Defense

From Wilshire’s Magazine of August 1907:

While reviewing the coverage of the Haywood Trial by Wilshire’s Magazine, we came across a particularly compelling photograph of the many witnesses who came to Boise in order to testify on behalf of Big Bill Haywood.

The photograph was from an article by John R. McMahon entitled “Story of the Famous Trial” wherein he had this to say about the witness:

In refreshing contrast to the State’s array of official scamps, deputy sheriffs, policemen, clerks, et al., there came to town an array of defense witnesses full of health and spirits, brawny, frank-eyed men and cheerful, resolute women. They did not have to be dragooned into comming; they rejoiced that they could be of service to their imprisoned comrades; their faces beamed with the hope and inspiration of a new day for the united workers of the land. They greeted one another affectionately and with crushing hand grips. It seemed that all the known and unknown veterans of the labor war of Colorado were gathered together. Nearly every man had been causelessly persecuted, jailed, bullpenned, deported, shot at or assaulted by mine owners’ thugs; every woman had been insulted, threatened, arrested or starved out for the crime of sheltering the homeless and giving food to the hungry. If this is the stuff that the western working class is made of, we need have never a fear. These people thrive on persecution.

Idaho and Nevada – Western Federation of Miners on the Firing Line

Through their ownership of state and federal government power, the Mine Owners carry on their battle against the Western Federation of Miners. The Socialist Montana News of December 5th reports:

PETTIBONE TRIAL BEGINS

Boise, Idaho, Dec. 1.—Sheriff Shad Hodgins and force of deputies yesterday completed the serving of summons on the talesmen for the special venire of 100, to respond for service when the Pettibone trial is resumed Monday morning at 10 o’clock.

During the day yesterday the eleven talesmen now in the custody of the bailiffs awaiting the opening of court Monday, informally reported at the court house and to the court. They were given magazines, papers and reading matter, all of which had been censored relative to anything concerning the trial, after which they returned to the quarters at 612 Bannock street where they enjoyed a session of news, fiction and romantic. In the afternoon they took a long walk out beyond the Boise barracks returning just before the supper hour.

Attorney W. E. Stone of counsel for the state was appointed by the court to censor the reading matter that is to go to the jury during the trial and Leon Whitsell for the defense.

The defendant’s health is still very poor and he is barely able to climb the two flights of stairs to the court room. He continues to give assurances however, that he will be able to sit through the trial.

The elimination of testimony in regard to the Colorado labor war, which was stricken out by Judge Wood in the Haywood trial, will mean the saving of much time, and it is believed that the taking of testimony will not require over four weeks.

Rathdrum, Idaho – Jury Fails to Convict Steve Adams

The second trial of Steve Adams for the murder of Fred Tyler has ended with a second jury hung. Ida Crouch-Hazlett reports the trial’s outcome in the November 28th edition of the Socialist Montana News:

STATE FAILS TO CONVICT

Rathdrum Ida., Nov. 24.

The jury in the Steve Adams case disagreed to-night at 5:45 after being out 21 hours. The case was given to the jury last night at 8.30. The result was 8 for acquittal and 4 for conviction. Gorwood, House Dittemore and Varnim were the men that hung out for conviction. Varnim leading the fight against Adams.

Papers were on hand to rearrest Adams in case of an acquittal and take him in one case to Telluride, Col., to be tied for the murder of Arthur Collin, and in the other to Wallace to be tried for the murder of Boulier, a notorious claim jumper and land stealer.

Adams was indicted last week in Telluride for killing Arthur Collins, the superintendent of the Smuggle Union mine, who was shot through a window.

It is said to-night, however, that Adams is to be retried on the Tyler charge, and will be held here at Rathdrum till the next term of court.

The intention is evidently to pursue Adams to the utmost, to break down his constitution and will if possible, and use him as a means to break down the Federation. The policy of the capitalist prosecution is to exhaust the treasuries of the unions through continuous attacks by the courts.

Pettibone’s trial at Boise has been postponed till Friday, Nov. 29.

BOISE, Idaho, Oct. 31-Attorneys for state and defense in the case of complicity in the murder of former Governor Steunenberg, today signed a stipulation that the trial, which was set for next Monday shall be continued until Nov. 18.

RATHDRUM, Idaho, Oct. 30.-The work of securing jurors to try Steve Adams progresses slowly. Most of today was taken up in the examination of L. G. Willis, one of the editors of the Coeur d’Alene Journal. The defense appears to be making a strong effort to get him off the jury. Attorney Clarence Darrow arrived yesterday and has taken charge of the examination of jurors. There are still 63 jurors in the box who have not been called.

Boise, Idaho – Haywood Family Attend Murder Trial

In this week’s edition (June 13th) of the Socialist Montana News, Ida Crouch-Hazlett describes the family members of Big Bill Haywood who sit in regular attendance at the trial of the Secretary-Treasurer of the Western Federation of Miners, charged with conspiring to murder the ex-governor of Idaho. Harry Orchard has been on the stand telling his tale of murder and mayhem and accusing the leaders of the W. F. of M. of directing him in his trail of villainy (see below).

Mrs. Steve Adams and Mrs. Pettibone attend court together-two handsome women, handsomely dressed. Mrs. Moyer’s sister is usually with them, a charming and dainty young girl. Mrs. Moyer has not yet appeared in court. Haywood’s mother, Mrs Caruthers, has arrived from Salt Lake with her daughter, a very pretty young girl of about twenty. The mother is a handsome women who carries herself well, and has a sweet expression on her face. They do not seem unduly agitated over the situation. They are upheld by the idea that it is all simply the part of a play in a great conspiracy.

The Haywood family are in court every day. Mrs. Haywood’s father, Mr. Miner, is here from Nevada, also Mr. McKinon, one of the Federation boys, who married her sister Winnie.

Appear in Court Monday.

Boise, Idaho, June 1.-The trial of William D. Haywood was interrupted today by the illness of the defendant who suffered an attack of intestinal poisoning early this morning. Physicians called to attend the prisoner found it necessary to administer opiates before the severe pain was relieved.

At the beginning of the morning session it was expected Haywood would be all right by afternoon, but when court reconvened the prisoner was too weak to be present. Adjournment was then taken until Monday [June 3rd].

Attorney Richardson said Haywood’s illness was not serious and there was no doubt of his ability to be ready Monday.

From Caldwell, Idaho: Ida Crouch-Hazlett Reports

Haywood, Wilshire's Magazine, 1906

In this weeks edition of the Montana News, Ida Crouch-Hazlett reports her observations of the ongoing events in the case of our imprisoned comrades, Haywood, Moyer, and Pettibone. She first describes the mental anguish of the murderer, Harry Orchard, saved from despair and suicide by the application of good food and fine cigars. But most importantly, she reports that she was able to have a talk with Bill Haywood, just after the close of court one day in the town of Caldwell, wherein Big Bill gave his opinion of the current conflict now upsetting the unity of the Industrial Workers of the World. Big Bill stated that the “scum rises to the top,” and that the I. W. W. will be stronger once the scum is skimmed off.

Included in the report is an editorial from the March 16th edition of The Industrial Union Bulletin entitled “Why They Want Haywood.”

Mine Owners After Haywood

Through the machinations of the capitalist press the public has almost forgotten the fiend who did the deed. Although implicating himself in the same crime, the admitted principal is relegated to the rear when it comes to punishment. This miserable wretch the tool of the Great Conspiracy that vibrates through this mountain air, of men against the labor that feeds and cloths them, this Judas already damned, as is well known to the real “inner circle,” a broadcloth one giving his star-chamber bosses the slip after all, from sheer physical and mental ability to carry on his part. He had become a prey to his own degenerate mental images, and had become so fearful and despondent, that existence was a misery to him, and he had decided on taking his life. He got hold of some arsenic and concealed it about his cell. He told Mrs. Steve Adams of his resolution. She plead with him not to think of such a thing, but he was obdurate. She then reported the matter to the guards, the cell was searched and the poison was found.

Warned in this way that they were liable to lose their most valuable asset, the conspirators saw that they would have to put heart into their dupe, so that now he has pleasant surroundings and accommodations, good food, cigars, and all things needful, and he’s getting braced up to meet the men on trial that he is trying to swear into eternity. Nice thought that. They might as well have let him die easy. His life does not amount to anything anyhow.
