Sacramento, California-Charges Dismissed Against Fred Little

Remember Frank Little Button, see HG IWW Trial, Aug 1, 1918

Fred Little, brother of Martyred Fellow Worker, Frank Little, is now free, having had charges against him dismissed by federal prosecutors. Emma Little, wife of Fred Little, has also suffered her share of persecution. Her home has been invaded by federal agents, her children terrorized, and her papers seized. Yet she continues steadfast in her support for the imprisoned members of the Industrial Workers of World.

From the San Francisco Examiner of December 10, 1918:

JURY EXAMINED TO TRY I.W.W.
—–
Four of Seven Talesmen Examined
Passed Temporarily
and Three Are Excused.
—–

SACRAMENTO, December 9.-Questions as to what impressions they had formed from reading literature on the Industrial Workers of the World, news stories and other matter relating to the Bisbee deportations more than a year ago and who they thought responsible for the dynamiting of the executive mansion here December 17, 1917, were asked by counsel for three of the defendants in the Industrial Workers of the World conspiracy trial, which was begun here today.

Four of seven talesmen who had been examined had been passed temporarily and three had been excused because of opinions they had formed regarding the case when court adjourned tonight.

Of the forty-seven defendants brought to trial only three were represented by an attorney. They were Miss Theodora Pollok, the only woman defendant; Basil Saffores and A. L. Fox of San Francisco. They were represented by Harry M. McKee, attorney of Fresno.

The entire examination of the prospective jurors was conducted by McKee so far as the defendants were concerned. A trial committee which forty-four of the defendants had selected to conduct their case took no part in the proceedings, apparently adhering to the program of a “silent defense,” which they were reported to have decided upon.

Charges against three defendants are dismissed today on motion of Robert Duncan, special attorney of the Department of Justice, who is conducting the prosecution. They were Fred Little, W. O. Kelley and Wilfred Dennis.

A demurrer urging the dismissal of the charges against Miss Pollok, Saffores and Fox was filed by McKee. This was taken under advisement by United States District Judge F. H. Rudkin of Spokane, Wash., who is presiding, as was also a motion by McKee to grant a separate trial to his three clients.

The fact that some of the defendants were not represented by counsel and that others had engaged attorneys created a condition, McKee contended, which was prejudicial to the interests of all concerned.

Note: Jane Little Botkin is the great grand niece of Labor Martyr Frank Little. This is the definitive life story of Frank Little, and, here, the story of a family’s journey to Remembrance has at long last been written. Botkin goes deep into the difficult life of Emma Little, giving to her long-overdue credit as a courageous labor activist.
