Some Relief for The Saint
INDICTMENTS AGAINST ST. JOHN ARE QUASHED.
—–DENVER, COLO., Sept. 7.-Six counts against Vincent St. John, charging conspiracy to murder and feloniously entering mining claims, were quashed in Judge Stevens’ court in Gunnison Wednesday.
The first two counts, charging St. John with directly killing Ben Burnham at the Sheridan mine in Telluride, July 3, 1901, and with being accessory to the killing, were allowed to stand.
District Attorney Seleg, in his argument in behalf of conspiracy charges, admitted he had no evidence to support direct murder charges. It is probable he will ask for a continuance of the case, but this Judge Stevens will refuse.
Judge Stevens declared yesterday that the St. John case must be disposed of at the October term of court, or the case will be thrown out.
The defense expects prompt acquittal in case of trial.
