Employers’ Liability.
Dagger of Courts v Employers’ Liability Bill.
A bill introduced today by Assemblyman McGrath of New York amends the labor law by extending the liability of the employer for liability for injury to an employe where the injury is caused without any fault of the latter.
“The Court of Appeals,” said McGrath, “pointed out in its recent decision declaring the law unconstitutional, that it is within the province of the Legislature to abrogate the outworn common law ‘fellow servant and contributory negligence’ rules and this bill is designed to meet the court’s suggestion with reference to the fellow servant doctrine.
